Effective January 1, 2027. Copyright notices go to our designated agent: [Designated DMCA agent (name; registration with the Copyright Office pending)], cardcafeadmin@gmail.com, 5171 Cobalt Falls Bnd, Aiken, SC 29801, [Designated agent telephone number]. Trademark complaints use section 6.
1. What this covers
Content users post or share on The Collectiv, such as collector profiles and share pages. Card artwork and data shown in The Collectiv tools come from the sources named beside them.
2. Sending a copyright notice
Send a written notice to our designated agent that includes:
(1) your physical or electronic signature, as the owner or a person authorized to act for the owner;
(2) identification of the copyrighted work (or a representative list if several works are involved);
(3) identification of the material you say is infringing and information reasonably sufficient for us to find it, such as the page address;
(4) your name, address, telephone number and email;
(5) a statement that you have a good-faith belief that the use isn’t authorized by the owner, its agent or the law; and
(6) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner.
Notices missing these elements may not be acted on. Knowingly false claims can create liability.
3. What we do with a valid notice
We remove or disable access to the material promptly and take reasonable steps to tell the person who posted it, including a copy or summary of the notice.
4. Counter-notices
If your content was removed and you believe that was a mistake or misidentification, send our designated agent a counter-notice that includes: your physical or electronic signature; identification of the removed material and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; and your name, address and telephone number, with a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which The Collectiv may be found) and will accept service of process from the person who sent the original notice or their agent.
We send a copy of a valid counter-notice to the person who sent the original notice, telling them we will restore the material in 10 business days. We restore it not less than 10 and not more than 14 business days after receiving the counter-notice, unless our designated agent first receives notice that they have filed a court action seeking to restrain the alleged infringement.
5. Repeat infringers
We close, in appropriate circumstances, the accounts of users who are repeat infringers. We keep a record of valid notices against each account to apply this policy reasonably. Removal and account decisions can be reviewed by contacting cardcafeadmin@gmail.com.
6. Trademark complaints
Trademark owners can report content they believe causes confusion or falsely suggests affiliation, with evidence of their rights, the specific content and why it’s confusing. Send these to cardcafeadmin@gmail.com. We may remove disputed content while we review. Complaints shouldn’t be used to remove lawful descriptive references, such as naming a card or a grading company accurately.
