Effective January 1, 2027. These Terms form an agreement between the user and [Legal company that operates TH3 COLL3CTIV3 (LLC not formed yet)] (“Company”) for TH3 COLL3CTIV3 services at www.th3coll3ctiv3.com.
1. Acceptance; eligibility
By selecting “I agree” or otherwise using services after legally sufficient notice, you agree to these Terms. If you do not agree, do not use the service. You must be at least [Minimum age] and capable of entering a binding agreement, or use the service only under a legally compliant parent/guardian framework. The person accepting for an organization warrants authority to bind it.
2. Service; no professional advice
The Collection Vault, Grading Lab, Submission Planner and Tracker, Trade Analyzer, Set Completion, Discover, the Concierge, certification lookups and market tools provide educational information, calculations and estimates based on what you enter and on third-party data. They aren’t appraisals, financial or investment advice, professional authentication, insurance valuations, or guarantees of grading outcomes, prices or profits. AI features can be wrong. Independently verify material decisions and costs. See the AI and price disclosure.
3. Accounts and security
Provide accurate information, safeguard credentials and promptly notify us at cardcafeadmin@gmail.com of suspected compromise. You are responsible for activity under your account except as prohibited by law. We may require verification to prevent abuse.
4. Your content and our limited license
You keep ownership of the photos, notes, collection records, profile text and other content you submit (“your content”). You confirm you have the rights needed to submit it.
You give Company and the service providers working for it a nonexclusive, worldwide, royalty-free license to host, copy, transmit, process and display your content only as needed to: (a) operate the features you use, including private processing such as AI analysis and price lookups; (b) show your opt-in public profile to anyone; (c) show what you choose to share, such as a share link or an Exchange proposal, to the audience you select; (d) secure, troubleshoot and support the service; and (e) comply with law. The license lasts as long as needed for those purposes and ends when you delete the content or your account, except for copies others already received through sharing you chose, records we must keep, and backups until overwritten.
We don’t use your content for advertising or promotion, or to train AI models, without your separate permission. We may remove content that breaks these Terms or the law.
5. Company intellectual property
Company retains all rights in its original software, designs, marks, text, product features and protectable databases, subject to third-party rights. We grant you a limited, revocable, nontransferable right to use the service for its intended purpose while you comply with these Terms. No rights are granted in third-party card artwork, trademarks or datasets.
6. Prohibited conduct
Follow the Community Standards, which are part of these Terms. In particular, don’t scrape or bulk export protected data without permission, reverse engineer except as law permits, evade usage limits or moderation, interfere with security, upload unlawful or infringing content, impersonate others, manipulate referral tracking, misrepresent cards, grades or certifications, resell access without permission, or use results to mislead anyone about official grading or authentication.
6A. Public profiles, sharing and the Exchange
Public profiles are optional. Before you publish one you must agree to the current Community Standards. What you publish, and anything you share by link, can be seen, copied and passed on by others; you can unpublish or delete it, but copies others already made can’t be recalled.
The Exchange isn’t open. If it opens, the Exchange Terms will apply in addition to these Terms; trades will be agreements between collectors, and TH3 COLL3CTIV3 won’t be a party to them.
7. Third-party data, links and trademarks
Prices, card details, certification information and links may originate from independent providers and can be stale, incomplete or incorrect. We do not control third-party purchases, grading decisions, shipping or refunds. Third-party trademarks are used for identification only; no affiliation or endorsement is implied unless expressly stated. 8. Availability and changes
We may maintain, modify, discontinue or restrict features for operational, legal or security reasons. For paid services, material changes, refunds and notice will follow the Subscription Terms and applicable law. Local-only collection records may be lost if browser data is deleted; keep independent backups.
9. Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY. NOTHING EXCLUDES RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
10. Liability limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS OFFICERS, MEMBERS, EMPLOYEES AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST CARD VALUE OR MISSED SALES. SUBJECT TO NON-WAIVABLE LAW, TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF [Liability Cap] OR AMOUNTS YOU PAID COMPANY FOR THE SERVICE IN THE [Liability Lookback Months] MONTHS BEFORE THE EVENT. THIS CAP DOES NOT APPLY WHERE PROHIBITED, INCLUDING ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
11. User indemnity
To the extent allowed by law, business users and creators will defend and indemnify Company from third-party claims arising from their unlawful content, intentional misconduct, infringement or material contractual breach, excluding claims caused by Company’s own wrongdoing.
12. Suspension; termination
We may restrict content or features, or suspend or close an account, for security threats, fraud, illegal conduct, repeated infringement or material or repeated breaches of these Terms or the Community Standards. Where appropriate we’ll tell you why and how to ask for a review at cardcafeadmin@gmail.com. You may stop using free services at any time and delete your account in your profile. Paid-plan cancellation and refunds are governed by the Subscription Terms and applicable law. Clauses about accrued obligations, intellectual property, disclaimers, liability and disputes survive as appropriate.
13. Disputes; governing law

14. General terms
If a provision is unenforceable, the remainder continues where legally possible. Failure to enforce is not waiver. Company may assign these Terms in a lawful sale or reorganization; user assignment requires consent. We will give legally required notice of material changes.
