Effective January 1, 2027. These terms supplement the Terms of Service, the Community Standards and the Privacy Policy for buying and selling on The Collectiv Market, operated by [Legal company that operates TH3 COLL3CTIV3 (LLC not formed yet)] (“The Collectiv,” “we”).
1. What the Market is
The Collectiv Market lets collectors list trading cards from their The Collectiv Vault for sale at a fixed price, and lets other collectors buy them. Each order has one seller and ships to an address in the United States. Prices are in US dollars.
Sellers own and ship the cards they list. The Collectiv doesn’t own, inspect, grade, store or ship cards, and it doesn’t authenticate them. A catalog match, a rarity label or a certification-number lookup is not proof that a card or slab is genuine, and the AI tools in The Collectiv are estimates, not official grades.
2. Payments
Payments are processed by Stripe. When a buyer pays, the charge is made by The Collectiv through Stripe and the seller’s share is transferred to the seller’s Stripe connected account. Sellers are paid out by Stripe on the schedule set for their Stripe account. The Collectiv doesn’t hold sale proceeds in a separate account and doesn’t offer escrow.
An order counts as paid only when Stripe confirms the payment to The Collectiv. A page shown after checkout is not confirmation.
Marketplace fee: [Marketplace fee charged to sellers (or none) — owner decision]. The Collectiv will show any fee to the seller before they publish a listing and on each sale. We won’t add or change a fee on a listing without telling the seller first.
Sales tax: [Who collects and remits sales tax on Market orders — needs qualified tax review].
3. Selling
To sell you need a The Collectiv account and a Stripe account set up through The Collectiv’s onboarding. Stripe collects and verifies identity and bank details; The Collectiv doesn’t store them. Seller eligibility: you must be at least 18 years old, live in the United States, and complete Stripe’s identity and bank verification.
You must own each card you list and have the right to sell it. Describe it honestly: the correct card, set, number, variant, language and condition, and every flaw you know of. Use your own photos of the actual card (the front and back of a raw card, or the slab and its label). Don’t use stock or catalog images, and don’t edit photos in a way that hides condition.
Ship within the handling time on your listing, to the address The Collectiv gives you for that order, packed to protect the card. Add the carrier and tracking number. The Collectiv shows tracking numbers as entered by the seller and doesn’t verify delivery.
If you can’t ship, cancel the order before it ships so the buyer is refunded in full. Refunds are taken back from your share of the sale.
4. Buying
Read the listing, its photos, its flaws and its return policy before you buy. Message the seller through the order page with any question. Pay only through The Collectiv checkout: don’t pay a seller any other way, and report anyone who asks you to.
When the card arrives, confirm receipt on the order page. If it doesn’t arrive, or it isn’t as described, open a request on the order page.
5. Returns, cancellations and refunds
Each listing shows the seller’s return policy, chosen from the policies The Collectiv offers. Return or request window: 30 days after delivery.
Refunds are issued through Stripe to the original payment method. A refund is shown as complete only when Stripe confirms it.
The Collectiv may cancel an order and refund the buyer when an item can’t be supplied (for example, when it sold out before a late payment arrived), when a seller doesn’t ship, or when we reasonably believe a listing breaks these terms. We don’t promise a particular outcome for every request, and these terms don’t create a buyer guarantee.
6. Payment disputes
If a buyer disputes a charge with their bank, The Collectiv responds to the dispute with Stripe and may ask both parties for information. If the dispute is lost or accepted, The Collectiv may recover the disputed amount from the seller’s share of that sale, as the Stripe connected account agreement allows. Dispute handling details: If a buyer’s bank dispute is lost or accepted because the seller didn’t ship, didn’t add tracking, or the item wasn’t as described, TH3 COLL3CTIV3 may recover the disputed amount and any dispute fee from the seller by reversing the transfer for that sale. If the seller shipped to the address TH3 COLL3CTIV3 provided, added tracking, and described the item accurately, TH3 COLL3CTIV3 will contest the dispute with the evidence the seller provides.
7. Not allowed
Counterfeit, proxy or reprinted cards presented as originals; stolen goods; items you don’t have; misleading titles, grades, certification numbers or photos; shill buying or fake reviews; moving a sale off The Collectiv to avoid checkout; collecting buyers’ data for any other purpose; and anything the Community Standards prohibit.
The Collectiv may remove listings, pause selling, restrict accounts, or hold back from listing new items while we review a report. Restricting a Stripe account is decided by Stripe.
8. Reviews and reports
Only a buyer who confirmed receipt of an order can review its seller, once per order. Reviews must be honest and about that order. Anyone can report a listing, an order or a message; our team reviews reports and keeps a record of what was done.
9. Your information
Buyers’ shipping addresses are shared with the seller only after payment, only to ship that order. Order messages are visible to both parties and, when needed for support, safety or a dispute, to The Collectiv staff. See the Privacy Policy.
10. Changes and contact
We may update these terms; material changes take effect for new listings and orders after notice. Questions: cardcafeadmin@gmail.com. Governing law: [Governing Law].
