Effective January 1, 2027. These Terms form an agreement between the user and Rarivelle LLC (“Company”) for Rarivelle services at www.th3coll3ctiv3.com.
1. Acceptance; eligibility
By selecting “I agree” or otherwise using services after legally sufficient notice, you agree to these Terms. If you do not agree, do not use the service. You must be at least [Minimum age] and capable of entering a binding agreement, or use the service only under a legally compliant parent/guardian framework. The person accepting for an organization warrants authority to bind it.
2. Service; no professional advice
The Collection Vault, Grading Lab, Submission Planner, certification lookups and market tools provide educational information and estimates, not appraisals, financial or investment advice, professional authentication, insurance valuations or guarantees of grading outcomes or profits. Independently verify material decisions and costs.
3. Accounts and security
Provide accurate information, safeguard credentials and promptly notify us at cardcafeadmin@gmail.com of suspected compromise. You are responsible for activity under your account except as prohibited by law. We may require verification to prevent abuse.
4. User submissions and license
You retain ownership of card photos, notes and other materials you submit. You represent that you have necessary rights to submit them. You grant Company and its contracted processors a nonexclusive, worldwide, royalty-free license solely to host, transmit, process, display to you, troubleshoot and protect the service, and comply with law, for the time reasonably needed to provide those functions. No public promotional use of your photos without separate permission. We may remove unlawful or infringing submissions.
5. Company intellectual property
Company retains all rights in its original software, designs, marks, text, product features and protectable databases, subject to third-party rights. We grant you a limited, revocable, nontransferable right to use the service for its intended purpose while you comply with these Terms. No rights are granted in third-party card artwork, trademarks or datasets.
6. Prohibited conduct
Do not scrape or bulk export protected data without permission, reverse engineer except as law permits, evade usage limits, interfere with security, upload unlawful content, impersonate others, manipulate referral tracking, generate fraudulent certifications, resell service access without permission, or use results to mislead buyers about official grading or authentication.
7. Third-party data, links and trademarks
Prices, card details, certification information and links may originate from independent providers and can be stale, incomplete or incorrect. We do not control third-party purchases, grading decisions, shipping or refunds. Third-party trademarks are used for identification only; no affiliation or endorsement is implied unless expressly stated. 8. Availability and changes
We may maintain, modify, discontinue or restrict features for operational, legal or security reasons. For paid services, material changes, refunds and notice will follow the Subscription Terms and applicable law. Local-only collection records may be lost if browser data is deleted; keep independent backups.
9. Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR ACCURACY. NOTHING EXCLUDES RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.
10. Liability limitations
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY AND ITS OFFICERS, MEMBERS, EMPLOYEES AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST CARD VALUE OR MISSED SALES. SUBJECT TO NON-WAIVABLE LAW, TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF [Liability Cap] OR AMOUNTS YOU PAID COMPANY FOR THE SERVICE IN THE [Liability Lookback Months] MONTHS BEFORE THE EVENT. THIS CAP DOES NOT APPLY WHERE PROHIBITED, INCLUDING ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.
11. User indemnity
To the extent allowed by law, business users and creators will defend and indemnify Company from third-party claims arising from their unlawful content, intentional misconduct, infringement or material contractual breach, excluding claims caused by Company’s own wrongdoing.
12. Suspension; termination
We may suspend access for credible security threats, fraud, illegal conduct or material violations, with notice and appeal where appropriate. You may stop using free services at any time. Paid-plan cancellation, accrued charges and any refunds are governed by the Subscription Terms and applicable law. Clauses concerning accrued obligations, IP, disclaimers, liability and disputes survive as appropriate.
13. Disputes; governing law

14. General terms
If a provision is unenforceable, the remainder continues where legally possible. Failure to enforce is not waiver. Company may assign these Terms in a lawful sale or reorganization; user assignment requires consent. We will give legally required notice of material changes.
